What happens to your information when you visit this site or contact us. The short version: this website collects nothing.

The website

This site collects nothing about you.

These are plain pages. The site sets no cookies. It runs no analytics and no tracking of any kind. It loads no fonts, images, scripts or content from any other company, so no third party learns that you were here. There is nothing to opt out of, because nothing is switched on.

The contact form does not send us anything by itself. When you press the button, the page opens a new message in your own email program with the boxes you filled in already typed into it. You decide whether to send it. Until you do, nothing has left your device, and this website never sees what you wrote. If your device has no email program set up, nothing will appear to happen — in that case please email info@nunezadvisory.com directly.

Once you contact us

What we then hold, and what we do with it.

When you email, call, or send that message, we hold what you chose to tell us: your name, your email address, your telephone number if you gave one, the kind of matter, the names of the parties and their counsel, the project, and your availability. For enquiries that are not about a mediation, we also hold your role, the stage of the work, and what you need.

That information sits in our business email and in our own matter files. We use it to answer you, to run the conflicts check, and, if we are engaged, to carry out the work.

We never sell, rent or trade your information, and we never use it for advertising. We send no marketing email unless you ask to receive one.

Suppliers

Only the ordinary ones.

A few outside services are involved, and only in the ordinary way: a web host that serves these pages, a business email and calendar provider, and an off-site backup service holding encrypted copies of firm files. Services like these handle what you send us only so that it reaches us or stays safe. We add no tracking, we receive no visitor reports, and nothing is sold, rented or used for advertising. The firm has no employees and no assistants.

Retention

How long we keep things.

The firm has a written document-retention policy and it governs. A matter closes when the closing letter goes out, or when a continued mediation ends. In plain terms:

  • An enquiry that never becomes a matter is kept, not deleted. We need it so that a conflicts check years later finds the earlier contact.
  • Signed agreements, invoices, payment records and the letters sent after a session: at least seven years after the matter closes.
  • Documents the parties send for the mediation: returned or securely destroyed within 30 days after the matter closes, unless all parties ask otherwise in writing, or the law or a court order requires them to be kept.
  • The mediator’s notes, including notes from private sessions: securely destroyed within seven days after the closing letter, unless we are required to preserve them. They are never given to any party.
  • A signed settlement document: the parties keep it. We keep no copy unless all parties ask us to.

Deleting means the file goes from our systems. Copies already written to our encrypted backups are not individually retrievable and expire on the backup service’s own schedule. No session is recorded or transcribed, so no recordings and no transcripts exist at all.

Mediation

Mediation confidentiality is separate, and it is stronger.

If we mediate your dispute, the confidentiality of that mediation is governed by Texas law, by the engagement agreement every party signs, and by the ethical standards a mediator is bound to. Nothing on this page limits any of that. This page is about an ordinary website and an ordinary mailbox; a mediation is held to a much higher standard.

One thing worth being plain about, because it is often misunderstood: Texas law protects what is said and produced in a mediation from being used as evidence against a participant. It does not make a document secret that would have been discoverable anyway.

Please do not send us the dispute. If you are contacting us about a mediation, send only the names of the parties, their counsel and the project, and copy all counsel if you can. Do not describe the dispute and do not attach documents. We need the names to run a conflicts check, nothing more. One side’s account of a dispute, arriving before anyone is appointed, is exactly what a neutral must not have. If a mediation follows, every party is told before it begins that this contact was made.

Your choices

Asking what we hold.

Write to us and we will tell you what we hold about you, and correct anything that is wrong. We will not change the record of a matter at one party’s request; if you disagree with something in it, we will note that alongside it. Anything the retention periods above do not require us to keep, we will delete if you ask.
